Foreword

2015 marks the 50th anniversary of the Otago Law Review. In the Preface to the inaugural issue in 1965 the Dean of the Faculty of Law, Professor FW Guest, expressed both “pleasure and some surprise” at the establishment of the Review by the Otago University Law Students’ Association, adding a cautionary note that “in the meantime there can be no promise of an annual Review of this nature”. Fifty years hence, we can report that Professor Guest’s concerns were unfounded, the Review having been published annually since 1965.

Although the Otago Law Review began as a student venture, its contents were never confined to student work. Indeed, the first issue attracted a number of contributions from the academic staff within the Law Faculty itself. In present times, a large proportion of the works published in the Review are from outside the Faculty.

In 1969 the Otago Law Review Trust Board, consisting of members of the Faculty and student representatives, assumed responsibility for the Review. That arrangement continues to this day, with the addition in

2010 of an International Editorial Board currently comprising Professor Andrew Ashworth (Oxford), Professor Dame Hazel Genn (University College London) and Professor Jeremy Waldron (New York University School of Law).

To observe the occasion of attaining our half century we are pleased to bring you a somewhat larger than normal issue of the Otago Law Review. We are also delighted to have secured contributions from the founding Editor of the Review, Professor Don McRae, as well as from retired Judge Fred McElrea who wrote an article in the 1965 issue.

It is a tribute to the 20 and more editors of the Otago Law Review that

it continues to flourish. We now set our sights on another uninterrupted

50 years of the Otago Law Review.
