4. The Hokitika Municipal Ordinance 1866.
Analysis. Preamble.
1. Municipal Electoral Officers Hokitika declared to have been duly elected.
2. Title.
Whereas in pursuance of the powers vested in him by Section 3 of “The Municipal Council Ordinance” Session XIV. No. 2 the Superintendent of the Province of Canterbury did upon the Petition of one hundred householders resident within the town of Hokitika praying that the said town might be declared a Municipal District under the said Ordinance by and with the advice of the Executive Council of the said Province by Proclamation published in the Government Gazette of the said Province of Canterbury on the Thirtieth day of
May One thousand eight hundred and sixty-six declare the town of Hokitika to
be a Municipal District under the said recited Ordinance
by the name of the Town
of Hokitika Whereupon the householders of the said town of Hokitika and others
entitled to vote nominated
and elected certain persons to be Members of the
Municipal Council for the said town of Hokitika And whereas doubts have arisen
as to the validity of such elections which doubts it is expedient to
remove.
Be it therefore enacted by the Superintendent of the Province of Canterbury
by and with the advice and consent of the Provincial Council
thereof as
follows:
1. Municipal Electoral Officers Hokitika declared to have been duly elected. That the several persons who were declared by the Chairman and Assessors appointed to conduct the first election of Councillors for the said Town of Hokitika at the Warden’s Court in the said town in the month of October One thousand eight hundred and sixty-six to have been duly elected to serve as the Members of the said Municipal Council are hereby declared to have been duly elected according to law and shall and may during their respective terms of office have and exercise all the rights powers and privileges conferred upon Municipal Councils by the said recited Ordinance notwithstanding any error omission or irregularity in the mode of conducting such election or any proceedings
precedent thereto.
2. Title.
This Ordinance shall be entituled and may be cited as “The Hokitika Municipal
Ordinance 1866.”
Notes.
This Ordinance was passed by the Canterbury Provincial Council on the 27th
December 1866, and assented to by the Superintendent, WS Moorhouse, on the
29th December.
