LEGAL ADVICE
CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990:
STANDARDS AND CONFORMANCE BILL 2005

  1. We have considered the Standards and Conformance Bill 2005 (‘the Bill’) for consistency with the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). The Ministry of Justice received the final version of the Bill on 14 June 2005 and it was introduced into the House of Representatives on the same day. It is currently awaiting its first reading.
  2. The purpose of the Bill is to amend the Standards Act 1988 and the Testing Laboratory Registration Act 1972 in order to align the functions of the Standards Council and the Testing Laboratory Registration Council with international standards and conformance norms and practices. The amendments contained in the Bill are mainly of a technical nature.
  3. We consider that the Bill appears to be consistent with the Bill of Rights Act.
  4. In accordance with previous practice, we attach a copy of this opinion for referral to the Minister of Justice. We also attach a copy for referral to the Minister of Commerce, if you agree.
