LEGAL ADVICE
CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990:
MEDICINES (SPECIFIED BIOTECHNICAL PROCEDURES) AMENDMENT BILL

  1. We have considered whether the Medicines (Specified Biotechnical Procedures) Amendment Bill (the "Bill") (PCO 6436/3) is consistent with the New Zealand Bill of Rights Act 1990 (the "Bill of Rights Act"). We understand that the Bill will be considered by the Cabinet Legislation Committee at its meeting on Thursday, 31 March 2005.
  2. The Bill proposes to amend Part 7A of the Medicines Act 1981 which controls xenotransplantation procedures in respect of human beings. Part 7A expires on 30 June 2005. Specifically, the Bill proposes to:
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed by the Bill of Rights Act.
  4. In accordance with previous practice, we attach a copy of this advice for referral to the Minister of Justice. A copy is also attached for referral to the Minister of Health, if you agree.
