LEGAL ADVICE

CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990: PALMERSTON NORTH RESERES EMPOWERING AMENDMENT BILL

1. We have considered the Palmerston North Reserves Empowering Amendment Bill ('the Bill')

for consistency with the New Zealand Bill of Rights Act 1990 ('the Bill of Rights Act').

2. The Bill, a Local Bill in the name of Hon Steven Maharey MP, was introduced into the House of Representatives on 15 March 2007 and is currently awaiting its first reading. We understand that the next Members' day is scheduled for Wednesday 28 March 2007.

3. The purpose of the Bill is to vest the land described in the Schedule in the Palmerston North City Council ('the Council') and to enable the Council to sell the land if it becomes surplus to the Council's requirements.

4. We have concluded that the Bill appears to be consistent with rights and freedoms affirmed in the Bill of Rights Act.
