Last Updated: 16 March 2020

Palmerston North Showgrounds Act Repeal Bill

13 June 2008

Attorney-General

LEGAL ADVICE

CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990: PALMERSTON NORTH SHOWGROUNDS ACT REPEAL BILL

1. We have considered whether the Palmerston North Showgrounds Act Repeal Bill ("the Bill") is consistent with the New Zealand Bill of Rights Act 1990 ("the Bill of Rights Act"). The Bill, a Private Bill in the name of Hon Steve Maharey, was introduced into the House of Representatives on 29 May 2008 and is currently awaiting its first reading. We understand that the next Members' day is scheduled for 18 June 2008.

2. The Bill provides for the transfer of the management and control of the land that comprises the Palmerston North Showgrounds from the Palmerston North Showgrounds Board of Control to the Palmerston North City Council, the dissolution of the Palmerston North Showgrounds Board of Control, and the repeal of the Palmerston North Showgrounds Act 1974.

3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
