LEGAL ADVICE

CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990: CHRISTCHURCH CITY COUNCIL (LANCASTER PARK) LAND VESTING BILL


  1. We have considered whether the Christchurch City Council (Lancaster Park) Land Vesting Bill (‘the Bill’), a Local Bill in the name of Tim Barnett MP, is consistent with the New Zealand Bill of Rights Act 1990 (‘Bill of Rights Act’). The Bill was introduced to the House of Representatives on 13 February 2008 and is currently awaiting its first reading. The Ministry understands that the next Members’ Day is scheduled for 20 February 2008.
  2. The purpose of this Bill is to facilitate the redevelopment of Lancaster Park as a modern sports stadium for the future. It seeks to realise this aim by vesting Lancaster Park land in the Christchurch City Council to be held in trust for certain specified purposes and dissolving the Victory Park Board.
  3. The Bill repeals the Victory Park Act 1919.
  4. We have reached the conclusion that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
