Lawyers and Conveyancers Amendment Bill (No 2)

18 June 2008

Attorney-General

Lawyers and Conveyancers Amendment Bill (No 2) (PCO 222/1) Our Ref: ATT395/67

I have reviewed the Lawyers and Conveyancers Amendment Bill (No 2) for consistency with the New Zealand Bill of Rights Act 1990.

The Bill proposes to amend the Lawyers and Conveyancers Act 2006 to clarify the position of lawyers who are employed by unions or employers organisations, who provide regulated services to members of those organisations. The Bill is intended to make it clear that such services do not contravene the Act.

It is noted that advice on the consistency of the Lawyers and Conveyancers Bill (now the

Act) was provided on 23 May 2003. That advice concluded that none of the provisions of the

Bill as at that date appeared to be inconsistent with the Bill of Rights Act.

This Bill raises no new issues. There is no apparent inconsistency with the Bill of Rights Act. In accordance with Crown Law practice, this opinion has been peer reviewed by Ben Keith,

Crown Counsel.

Yours sincerely

Victoria Casey

Crown Counsel
