LEGAL ADVICE

CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990: FRANKLIN DISTRICT COUNCIL (CONTRIBUTION TO FUNDING OF MUSEUMS) AMENDMENT BILL

1. We have assessed whether the Franklin District Council (Contribution to Funding of Museums) Amendment Bill (“the Bill”) is consistent with the New Zealand Bill of Rights Act 1990 (“Bill of Rights Act”). The Bill, a Local Bill in the name of Dr Paul Hutchison MP, was introduced into the House of Representatives on 13 August 2008 and is currently awaiting its first reading. The Ministry understands that the next Members’ Day is scheduled for 27 August

2008.

2. This Bill seeks to exclude any part of the district of the Franklin District Council that is not within the boundaries of the Auckland Regional Council from calculations of levies payable to the Auckland War Memorial Museum and the Museum of Transport and Technology.

3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
