CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990: TARIFF (NEW ZEALAND–HONG KONG, CHINA CLOSER ECONOMIC PARTNERSHIP AGREEMENT) AMENDMENT BILL


  1. We have considered whether the Tariff (New Zealand–Hong Kong, China Closer Economic Partnership Agreement) Amendment Bill (PCO 14301/2.2) (‘the Bill’) is consistent with the New Zealand Bill of Rights Act 1990 (‘Bill of Rights Act’). We understand that the Bill is likely to be considered by the Cabinet Business Committee at its meeting on Monday, 12 April 2010.
  2. The Bill amends the Tariff (in accordance with s 9F(1) of the Tariff Act 1988) to enable a bilateral free trade agreement to be brought into force, namely the New Zealand–Hong Kong, China Closer Economic Partnership Agreement. The amendments will have the effect of enabling preferential tariff rates to be applied to goods imported from Hong Kong.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed by the Bill of Rights Act. This advice has been prepared by the Public Law Group and the Office of Legal Counsel.
