CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990:

CIVIL AVIATION (CAPE TOWN CONVENTION AND OTHER MATTERS) AMENDMENT BILL


  1. We have considered whether the Civil Aviation (Cape Town Convention and Other Matters) Amendment Bill (“the Bill”) is consistent with the New Zealand Bill of Rights Act 1990 (“Bill of Rights Act”). We understand that the Bill is to be considered by the Economic Growth and Infrastructure Committee on Thursday, 27 May 2010.
  2. The Bill amends the Civil Aviation Act 1990, the Personal Property Securities Act 1999, as well as various company, insolvency and statutory management legislation to enable New Zealand to accede to the Convention on International Interests in Mobile Equipment, and to the associated protocol to the Convention on International Interests in Mobile Equipment on Matters Specific to Aircraft Equipment. The Bill also amends powers in the Civil Aviation Act 1990 relating to the making of civil aviation rules.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed by the Bill of Rights Act. This advice has been prepared by the Public Law Group and the Office of Legal Counsel.
