CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990:

SLEEPOVER WAGES (SETTLEMENT) BILL


  1. We have considered whether the Sleepover Wages (Settlement) Bill PCO 15512/6.1 (‘the

Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). We understand that the Bill will be considered by Cabinet at its meeting on Monday, 26 September 2011.

  1. The Bill follows the decision of the Court of Appeal in Idea Services Limited v Phillip William Dickson [2011] NZCA 14, in which the Court of Appeal confirmed a decision of the Employment Court that:

settlement (‘the settlement’) and discontinued the litigation before the Supreme Court.
