LEGAL ADVICE

CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990:

GAME ANIMAL COUNCIL BILL


  1. We have considered whether the Game Animal Council Bill (PCO 15198/11.2) (“the Bill”) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (“the Bill of Rights Act”). We understand the Bill is likely to be introduced to the House of Representatives on or before 19 October 2011. We also understand that the Bill may be subject to further amendments before it is introduced to the House. We will provide you with advice on further amendments should this prove necessary.
  2. We have prepared this advice on the basis of an understanding with the Department of Conservation that, after the expected Cabinet consideration of the Bill on 10 October 2011, the Department will address an issue raised by cl 26 of the Bill in relation to s 25(c) (presumption of innocence).
  3. The Bill:

The Council will advise and make recommendations to the Minister of Conservation in relation to hunting game animals. The Council will also provide information and education to the hunting sector, promote safety initiatives and represent the views of the hunting sector.

We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act. This advice has been prepared by the Public Law Group and the Office of Legal Counsel.
