9 March 2011 ATTORNEY-GENERAL LEGAL ADVICE

CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990:

CANTERBURY EARTHQUAKE COMMEMORATION DAY BILL


  1. We have considered whether the Canterbury Earthquake Commemoration Day Bill

(PCO 15095/2.9) (the “Bill”) is consistent with the New Zealand Bill of Rights Act

1990 (the “Bill of Rights Act”). We understand that the Bill is likely to be introduced to the House of Representatives on 10 March 2011. We also understand that the Bill may be subject to further minor amendments before it is introduced to the House. We will provide you with further advice should this prove necessary.

  1. The Bill provides for a day of commemoration in Canterbury on 18 March 2011 to commemorate the devastating consequences of the Canterbury earthquake and, in particular, the aftershock that occurred on 22 February 2011. Canterbury Earthquake Commemoration Day is to be a public holiday for the purposes of the Holidays Act 2003.
  2. Clauses 3 and 7 of the Bill provide that it applies only in the areas of Canterbury that observe Christchurch Show Day as Canterbury Anniversary Day in accordance with the Holidays Act 2003.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act. This advice has been prepared by the Public Law Group and the Office of Legal Counsel.
