CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990:

HOUSING CORPORATION AMENDMENT BILL


  1. We have considered whether the Housing Corporation Amendment Bill (PCO

14969/7.0) (“the Bill”) is consistent with the New Zealand Bill of Rights Act 1990 (“Bill of Rights Act”). We understand that the Bill is likely to be considered by the Cabinet Legislation Committee at its meeting on Thursday, 24 March 2011.

  1. The Bill amends the Housing Corporation Act 1974 (“the Act”) to consolidate housing policy advice to Ministers within the Department of Building and Housing. The Bill aims to better align the objectives and functions of the Housing New Zealand Corporation with government agencies. The Corporation will retain its operational policy capability to support its business services, but will no longer be required to ensure that the Minister of Housing receives appropriate policy advice, or any other advice or information on housing and services related to housing.
  2. In addition, the Corporation will no longer be expected to undertake research and monitoring activities for the purpose of advising the Minister of Housing on housing and services related to housing.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act. This advice has been prepared by the Public Law Group and the Office of Legal Counsel.
