CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990: BUDGET MEASURES BILLS


  1. We have considered whether a suite of four related Bills (‘the Bills’) containing fiscal

measures as part of the Government’s Budget for 2012 are consistent with the rights and

freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). These Bills are the:


  1. We understand that the Bills will be considered by Cabinet at its meeting on Monday, 21 May 2012.
  2. We also understand that the two Taxation (Budget Measures) Bills could be combined into one Bill. Together, these Bills include measures to:
  3. The Social Security (Long-term Residential Care: Budget Measures) Amendment Bill contains measures to amend long-term residential care asset thresholds in the Social Security Act 1964.
  4. The Customs and Excise (Tobacco Products: Budget Measures) Amendment Bill contains measures to increase excise rates in the Customs and Excise Act 1996.
  5. We have concluded that the Bills appear to be consistent with the rights and freedoms affirmed in the Bill of Rights Act. This advice has been prepared by the Public Law Group and the Office of Legal Counsel.
