Criminal Procedure Legislation Bill


  1. I have considered this Bill for consistency with the New Zealand Bill of Rights Act 1990 (“the Bill of Rights Act”). I advise that the Bill appears to be consistent with the Bill of Rights Act.
  2. The Bill proposes a range of technical amendments to the Criminal Procedure Act 2011, and other related legislation. The amendments address inconsistencies, and clarify language so as to ensure that the Act, which comes fully into force in July 2013, properly reflects the intention of Parliament. None of the proposed amendments engage any of the rights guaranteed by the Bill of Rights Act.
  3. In accordance with Crown Law practice, this advice has been peer reviewed by Crown Counsel Jane Foster.
