CONSISTENCY WITH THE NEW ZEALAND BILL OF RIGHTS ACT 1990: Local Government

(Auckland Council) Amendment Bill (No 2) 12 APRIL 2013

  1. We have considered whether the Local Government (Auckland Council) Amendment Bill (No 2) (PCO 17342/3.0) (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). We understand that the Bill will be considered by the Cabinet Legislation Committee at its meeting on Thursday 18 April 2013.
  2. The Bill amends the Local Government (Auckland Council) Act 2009 (‘the Act’) to enable local boards established under the Act to delegate responsibilities, duties, or powers conferred or allocated to them under the Act.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
