Consistency with the New Zealand Bill of Rights Act 1990: Copyright (Parallel Importing of Films) Amendment Bill


  1. We have considered whether the Copyright (Parallel Importing of Films) Amendment Bill (PCO 17598/2.0) (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). We understand that the Bill will be considered by LEG at its meeting on Thursday, 27 June 2013.
  2. The Bill seeks to amend the Copyright Act 1994. A ban on the commercial parallel importation of films for 9 months from the date a film is first released expires on 31 October 2013. The Bill would impose the ban for a further 3 years but in a modified form so that the commercial parallel importation of films is banned for 5 months from the date a film is first released.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
