Consistency with the New Zealand Bill of Rights Act 1990: New Zealand Mission Trust Board (Otamataha) Empowering Bill

  1. We have considered whether the New Zealand Mission Trust Board (Otamataha) Empowering Bill (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). The Bill is a Private Bill in the name of Te Ururoa Flavell MP. The Bill was introduced into the House of Representatives on 22 August 2013 and is awaiting its first reading. We understand that the next Members’ Day is scheduled for 25 September 2013.
  2. The Bill seeks to transfer land in Tauranga and other property from the New Zealand Mission Trust Board to the Otamataha Trust. The Bill would extinguish the existing trusts and vest the trust property in the trustees of the new trust.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
