Consistency with the New Zealand Bill of Rights Act 1990: Land Transport(Safer Alcohol Limits for Driving) Amendment Bill

  1. We have considered whether the Land Transport (Safer Alcohol Limits for Driving)

Amendment Bill (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). The Bill is a Member’s Bill in the name of Iain Lees-Galloway, MP. The Bill was introduced into the House of Representatives on 26 September 2013 and is awaiting its first reading. We understand that the next

Members’ Day is scheduled for Wednesday, 23 October 2013.


  1. The Bill amends the Land Transport Act 1998 [1] to reduce the allowable blood alcohol content from 80 milligrams to 50 milligrams of alcohol per 100 millilitres of blood when driving. The Bill also reduces the current breath alcohol limit from 400 micrograms of alcohol per litre of breath to 250 micrograms.
  2. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.

[1] While it is clear that this Bill intends to amend the Land Transport Act 1998, an error in clause 4 of the current version of the Bill states that it amends the Transport Act 1998.
