Consistency with the New Zealand Bill of Rights Act 1990: Healthy Homes Guarantee Bill

1. We have considered whether the Healthy Homes Guarantee Bill (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). The Bill is a Member’s Bill in the name of Phil Twyford MP. The Bill was introduced into the House of Representatives on 24 October 2013 and is awaiting first reading. We understand that the next Members’ Day is scheduled for Wednesday, 13 November 2013.
   
2. The Bill amends two Acts (the Residential Tenancies Act 1986 and the Energy Efficiency and Conservation Act 2000) to ensure that every rental home in New Zealand meets minimum standards of heating and insulation. Landlords would need to comply with standards for rental homes set by the Energy Efficiency and Conservation Authority.
   
3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
