Consistency with the New Zealand Bill of Rights Act 1990: Dumping and Countervailing Duties Amendment Bill


  1. We have considered whether the Dumping and Countervailing Duties Amendment Bill (PCO 18297/2.3) (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’).
  2. The Dumping and Countervailing Duties Act 1988 (‘the Act’) imposes duties on imported goods that are exported to New Zealand at prices lower than the price the goods are sold for in the domestic market of the exporting country. This duty protects New Zealand industries from unfair trading practices.
  3. The Bill amends the Act to suspend the application of duties on imported construction material for a period of 3 years. The purpose of this amendment is to increase productivity in the construction sector.
  4. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
