Consistency with the New Zealand Bill of Rights Act 1990: Local Government (Auckland Council) Amendment Bill (No 3)


  1. We have considered whether the Local Government (Auckland Council) Amendment Bill (No 3) (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). The Bill is a Member’s Bill in the name of Maggie Barry MP. The Bill was introduced into the House of Representatives on 20 February 2014 and is awaiting first reading. We understand that the next Members’ Day is scheduled for Wednesday, 9 April 2014.
  2. The Bill amends the Local Government (Auckland Council) Act 2009 to prohibit candidates from serving as a member on 2 or more local boards at the same time. This prohibition is intended to prevent conflicts of interest arising from a person serving as a member of multiple local boards and to promote the efficacy and fairness of the local electoral system.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
