Consistency with the New Zealand Bill of Rights Act 1990: Education (Restoration of Democracy to University Councils) Amendment Bill


  1. We have considered whether the Education (Restoration of Democracy to University Councils) Amendment Bill (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’). The Bill is a Member’s bill.
  2. The Education Amendment Act 2015 made amendments to the Education Act 1989 (“the Act”) by repealing the requirement for elections and student representatives on Tertiary Institution Councils. The purpose of the Bill is to repeal those recent amendments and ensure mandatory student and staff representation on Tertiary Institution Councils.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
