Hon Christopher Finlayson QC, Attorney-General
LEGAL ADVICE
LPA 01 01 21
Consistency with the New Zealand Bill of Rights Act 1990: Airport Authorities
(Publicising Lost Property Sales) Amendment Bill
1. We have considered whether the Airport Authorities (Publicising Lost Property Sales) Amendment Bill (‘the Bill’), a member’s Bill in the name of Nuk Korako MP, is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act
1990 (‘the Bill of Rights Act’).
2. The Bill amends s 9(1)(ff) of the Airport Authorities Act 1966, replacing the words “the insertion of suitable advertisements in a newspaper circulating in the district where the airport is situated” with “publicising the sale in what the authority considers to be a fair and reasonable manner”.
3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
