Last Updated: 6 January 2019

Hon Christopher Finlayson QC, Attorney-General
LEGAL ADVICE
LPA 01 01 21
Consistency with the New Zealand Bill of Rights Act 1990: Education
(Public Good not Profit from Charter Schools) Amendment Bill
- We
have considered whether the Education (Public Good not Profit from Charter
Schools) Amendment Bill (‘the Bill’), a
member’s bill in the
name of Dr David Clark MP, is consistent with the rights and freedoms affirmed
in the New Zealand Bill
of Rights Act 1990 (‘the Bill of Rights
Act’).
- The
Bill amends Part 12A of the Education Act 1989 and seeks to remove the ability
of for-profit organisations to operate state-funded
charter schools.
- We
have concluded that the Bill appears to be consistent with the rights and
freedoms affirmed in the Bill of Rights Act.
