Consistency with the New Zealand Bill of Rights Act 1990: Sentencing
(Livestock Rustling) Amendment Bill
- We
have considered whether the Sentencing (Livestock Rustling) Amendment Bill
(‘the Bill’), a member’s bill in the
name of Ian McKelvie MP,
is consistent with the rights and freedoms affirmed in the New Zealand Bill of
Rights Act 1990 (‘the
Bill of Rights Act’).
- The
Bill is intended to deter people in engaging in the theft of livestock by, at
section 9 of the Sentencing Act 2002, adding livestock
rustling to the list of
aggravating factors to be taken into account at sentencing.
- We
have concluded that the Bill appears to be consistent with the rights and
freedoms affirmed in the Bill of Rights Act.
