Consistency with the New Zealand Bill of Rights Act 1990: Sentencing (Livestock Rustling) Amendment Bill

  1. We have considered whether the Sentencing (Livestock Rustling) Amendment Bill (‘the Bill’), a member’s bill in the name of Ian McKelvie MP, is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’).
  2. The Bill is intended to deter people in engaging in the theft of livestock by, at section 9 of the Sentencing Act 2002, adding livestock rustling to the list of aggravating factors to be taken into account at sentencing.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
