Consistency with the New Zealand Bill of Rights Act 1990: Sentencing
(Domestic Violence) Amendment Bill
- We
have considered whether the Sentencing (Domestic Violence) Amendment Bill
(‘the Bill’), a member’s bill in the
name of Hon Nanaia Mahuta
MP, is consistent with the rights and freedoms affirmed in the New Zealand Bill
of Rights Act 1990 (‘the
Bill of Rights Act’).
- The
Bill is intended to improve the reporting of domestic violence offending by, at
section 9 of the Sentencing Act 2002, adding domestic
violence to the list of
aggravating factors to be taken into account at sentencing.
- We
have concluded that the Bill appears to be consistent with the rights and
freedoms affirmed in the Bill of Rights Act.
