Consistency with the New Zealand Bill of Rights Act 1990: Litter (Increased Infringement Fee) Amendment Bill

  1. We have considered whether the Litter (Increased Infringement Fee) Amendment Bill (‘the Bill’), a member’s Bill in the name of Scott Simpson MP, is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’).
  2. The purpose of the Bill is to increase the maximum fine for the infringement offence of depositing litter in or on a public place, or in or on private land without the consent of its occupier. The amendment increases the maximum fine from $400 to $1,000.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
