Hon David Parker, Attorney-General
LEGAL ADVICE

Consistency with the New Zealand Bill of Rights Act 1990: KiwiFund
Bill
- We
have considered whether the KiwiFund Bill (‘the Bill’), a
member’s Bill in the name of Fletcher Tabuteau MP,
is consistent with the
rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990
(‘the Bill of Rights Act’).
- The
Bill establishes an independent working group with the objective of setting up a
government-owned and operated KiwiSaver provider
called KiwiFund. The purpose of
the proposed KiwiFund is to make available a KiwiSaver provider option that is
accountable to New
Zealand taxpayers. The Bill sets out the structure,
membership and requirements of the working group.
- We
have concluded that the Bill appears to be consistent with the rights and
freedoms affirmed in the Bill of Rights Act.
