Consistency with the New Zealand Bill of Rights Act 1990: KiwiFund Bill

  1. We have considered whether the KiwiFund Bill (‘the Bill’), a member’s Bill in the name of Fletcher Tabuteau MP, is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’).
  2. The Bill establishes an independent working group with the objective of setting up a government-owned and operated KiwiSaver provider called KiwiFund. The purpose of the proposed KiwiFund is to make available a KiwiSaver provider option that is accountable to New Zealand taxpayers. The Bill sets out the structure, membership and requirements of the working group.
  3. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
