Consistency with the New Zealand Bill of Rights Act 1990: Trans-Pacific Partnership Agreement (CPTPP) Amendment Bill

  1. We have considered whether the Trans-Pacific Partnership Agreement (CPTPP) Amendment Bill (‘the Bill’) is consistent with the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of Rights Act’).
  2. We have not yet received a final version of the Bill. This advice has been prepared in relation to the latest version of the Bill (PCO 20954/4.0). We will provide you with further advice if the final version includes amendments that affect the conclusions in this advice.
  3. The Bill amends the Trans-Pacific Partnership Agreement Amendment Act 2016 to make changes necessary for New Zealand to ratify the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.
  4. To that effect, it makes minor amendments to the following Acts and regulations:
    1. Copyright Act 1994;
    2. Customs and Excise Act 1996;
    1. Tariff Act 1988;
    1. Hazardous Substances and New Organisms Act 1996;
    2. Wine Regulations 2006;
    3. Overseas Investment Act 2005;
    4. Patents Act 2013;
    5. Trade Marks Act 2002; and
    6. Legislation Act 2012.
  5. We have concluded that the Bill appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act.
