Consistency with the New Zealand Bill of Rights Act 1990: New Zealand
Public Health and Disability (Waikato DHB) Elections Bill
- We
have considered whether the New Zealand Public Health and Disability (Waikato
DHB) Elections Bill (‘the Bill’) is consistent
with the rights and
freedoms affirmed in the New Zealand Bill of Rights Act 1990 (‘the Bill of
Rights Act’).
- We
have not yet received a final version of the Bill. This advice has been prepared
in relation to the latest version of the Bill
(PCO 22147/2.0). We will provide
you with further advice if the final version includes amendments that affect the
conclusions in
this advice.
- The
Bill exempts the Waikato District Health Board (the Waikato DHB) from the 2019
triennial general election in order to provide
for the continuation of the term
of office of a commissioner for the Waikato DHB until the repeal date. In order
to cancel the election,
the Bill disapplies certain provisions of the New
Zealand Public Health and Disability Act 2000 and the Local Electoral Act 2001
for the period that the Bill is in force.
- We
have concluded that the Bill appears to be consistent with the rights and
freedoms affirmed in the Bill of Rights Act.
