Last Updated: 28 December 2021

LEGAL ADVICE
LPA 01 01 24
Hon David Parker, Attorney-General
Consistency with the New Zealand Bill of Rights Act 1990: Palmerston North
Reserves Empowering Amendment Bill
- We
have considered whether the Palmerston North Reserves Empowering Amendment
Bill (the Bill), a Local Bill in the name of Tangi Utikere MP, is consistent
with the rights and freedoms affirmed in the New Zealand Bill
of Rights Act 1990
(the Bill of Rights Act).
- The
Bill amends the Palmerston North Reserves Empowering Act 1966 (the principal
Act) so that the land described in the Schedule (currently
held by the
Palmerston North City Council (the Council) under the Palmerston North Reserves
Act 1922) is vested in the Council for
the purposes of the principal Act
enabling the Council to sell the land if it becomes surplus to
requirements.
- We
have concluded that the Bill appears to be consistent with the rights and
freedoms affirmed in the Bill of Rights Act.
