Repeal: Repealed 1909, No 15

Amendments:

Type of Legislation: Public

Subject: Validation

Maori Land Court: Structures & Jurisdiction

Relevant Sections: s2: NLCt may inquire into title to lands in Second Schedule

as if Native title not extinguished.

s3: Validation of Crown grants already made.

First Schedule: Description of lands ceded to Governor.

Second Schedule: Description and allocation of lands returned to

tribes (Te Ai-tanga-a-Mahaki, Rongowhakaata, Ngatikahungunu

and Ngatitahapu [?= Ngaitahupo]).

Commentary: An arrangement had been made between the Crown and the Maori owners of lands near Poverty Bay to cede land to the Crown on condition that land would be given to certain members of the Colonial Defence Force and certain Friendly Natives. A Commission was to be set up to investigate claims and grant the land.

The preamble recites that after the various Crown Grants had been awarded, the Commission returned to the tribes the remaining land so ceded. Doubts had arisen about the validity of the proceedings and grants made. This Act gives effect to the deed of cession and makes provision for the Maori grantees of land to have their titles ascertained through the Native Land Court even if Native Title had already been extinguished.

(The preamble refers to the Ngaitahupo Hapu, although the Schedule refers to the Ngatitahapu Block.)

Cross Reference: NZPD vol 16 (1874) 990.
