Your Excellency,

I have the honour to propose, on the basis of friendly consultation, the following Agreement between the Government of New Zealand and the Government of the People's Republic of China (the Parties) on access for airline crew members:

1. Based on the principle of reciprocity, the crew of airlines from the two Parties (including crew with a third country's nationality) on commercial airline services shall enjoy entry to and exit within seven days from the territory of the other Party through the presentation of a valid passport, without having to apply for a visa. For each flight, the necessary crew information shall be provided to the relevant authorities of the other Party. Either party reserves the right to refuse leave to enter or stay in its territory to any person whom it considers undesirable in accordance with its laws and regulations in force.

2. After entering the territory of the other Party, if the above-mentioned crew wish to continue their stay for not more than a total of seven days from the date of entry due to: inter alia, normal crew shift changes; illness; accidents; plane malfunction; climate; or, other force majeure, they need not apply for a visa; whereas should the above-mentioned crew wish to


extend their stay beyond seven days (from the date of entry) for any reason, the crew shall apply for permission to extend their stay from the relevant authorities of the other Party.

If Your Excellency would kindly confirm, on behalf of the Government of the People's Republic of China, the aforementioned in a note of reply, then this Note and your responding Note shall constitute an Agreement between the Government of New Zealand and the Govemment of the People's Republic of China. The Agreement shall enter into force on the date of your responding Note, may be amended in writing with the mutual agreement of the parties, and shall remain in force until terminated by either party giving three months' written notice.

I have the honour to acknowledge receipt of Your Excellency's Note of 21 March 2007, which reads as follows:

"Your Excellency,
