AMENDING THE AGREEMENT ON A WORKING HOLIDAY SCHEME BETWEEN THE GOVERNMENT OF NEW ZEALAND AND THE ORIENTAL REPUBLIC OF URUGUAY

EXCHANGE OF NOTES AMENDING THE AGREEMENT ON A WORKING HOLIDAY SCHEME BETWEEN THE GOVERNMENT OF NEW ZEALAND AND THE ORIENTAL REPUBLIC OF URUGUAY

The New Zealand Embassy presents its compliments to the Ministry of Foreign Affairs of the Oriental Republic of Uruguay and has the honour to refer to the Agreement on a Working Holiday Scheme between the Government of New Zealand and the Government of the Oriental Republic of Uruguay (“the Agreement”) done at Montevideo on 16 November 2001.

The New Zealand Embassy has the further honour to propose the following amendments to the Agreement:

1. Delete Article 2(a) of the Agreement and replace with the following:

“(a) is a citizen of the Oriental Republic of Uruguay;”

2. Delete Article 6(a) of the Agreement and replace with the following:

“(a) is a citizen of New Zealand;”

3. Delete Article 2(c) of the Agreement and replace with the following:

“(c) is aged between eighteen (18) and thirty-five (35) years, both inclusive, at the time of application;”

4. Delete Article 6(c) of the Agreement and replace with the following:

“(c) is aged between eighteen (18) and thirty-five (35) years, both inclusive, at the time of application;”

5. Delete Article 5 of the Agreement and replace with the following:

“ARTICLE 5

The competent authorities of New Zealand shall require any citizen from the Oriental Republic of Uruguay who has entered New Zealand through the Scheme operating under this Agreement to comply with the laws and regulations of New Zealand and not to engage in employment or study that is contrary to the purpose of the Scheme. Participants in the Scheme shall not be permitted to engage in permanent employment during their visit to New Zealand. The competent authorities of New Zealand shall permit citizens of the Oriental Republic of Uruguay who have entered New Zealand under the Scheme to enrol in training or study courses not exceeding a total of six (6) moths duration during their stay in New Zealand.”

6. Delete Article 9 of the Agreement and replace with the following:

“ARTICLE 9

The competent authorities of the Oriental Republic of Uruguay shall require any citizen of New Zealand who has entered the Oriental Republic of Uruguay through the Scheme operating under this Agreement to comply with the laws and regulations of the Oriental Republic of Uruguay and not to engage in employment or study that is contrary to the purpose of the Scheme. Participants in the Scheme shall not be permitted to engage in permanent employment during their visit to the Oriental Republic of Uruguay. The competent authorities of the Oriental Republic of Uruguay shall permit citizens of New Zealand who have entered the Oriental Republic of Uruguay under the Scheme to enrol in training or study courses not exceeding a total of six (6) moths duration during their stay in the Oriental Republic of Uruguay.”

If the above is acceptable to the Ministry of Foreign Affairs of the Oriental Republic of Uruguay, the New Zealand Embassy has the further honour to propose that this Note, together with your confirmatory Note in reply will constitute an agreement amending the Agreement which will enter into force through an exchange of diplomatic notes on the date of receipt of the later notification advising the completion of internal procedural requirements for entry into force.

The New Zealand Embassy takes this opportunity to renew to the Ministry of Foreign Affairs of the Oriental Republic of Uruguay the assurances of its highest consideration.

The Ministry of Foreign Affairs of the Oriental Republic of Uruguay presents it compliments to the New Zealand Embassy and has the honour to refer to the Embassy’s Note number 2010/37 dated 14 December 2010, which reads as follows:

“The New Zealand Embassy presents its compliments to the Ministry of Foreign Affairs of the Oriental Republic of Uruguay and has the honour to refer to the Agreement on a Working Holiday Scheme between the Government of New Zealand and the Government of the Oriental Republic of Uruguay (“the Agreement”) done at Montevideo on 16 November 2001.

The New Zealand Embassy has the further honour to propose the following amendments to the Agreement:

The Ministry of Foreign Affairs of the Oriental Republic of Uruguay has the further honour to advise that the above proposal is acceptable to the Government of the Oriental Republic of Uruguay and to confirm that the Embassy’s Note number 2010/37 dated 14 December 2010 and this confirmatory Note in reply shall constitute an agreement amending this Agreement which will enter into force through an exchange of diplomatic notes on the date of receipt of the latter notification advising for the completion of internal procedural requirements for entry into force.

The Ministry of Foreign Affairs of the oriental Republic of Uruguay takes this opportunity to renew to the New Zealand Embassy the assurances of its highest consideration.
