COMMERCE ACT 1986 - SECT 54O
Breaches of control imposed, or administrative settlements entered into, after 1 April 2009
54O Breaches of control imposed, or administrative settlements entered into,
after 1 April 2009
1 If a supplier breaches control imposed, or an
administrative settlement entered into, in accordance with section 54N(3) ,
the breach may be dealt with under Part 6 as if it were a breach of a
customised price-quality path, despite anything in the terms of the control or
settlement.
2 To avoid doubt, this section applies whether or not the
supplier is, after 1 April 2009, subject to default/customised price-quality
regulation.
History: Section 54O: inserted, on 1 April 2009, by section 4 of
the Commerce Amendment Act 2008 (2008 No 70).
