Effect of alternative orders
26 Effect of alternative orders
1 An order made under section 25(1)(a) is
to be regarded as a compulsory treatment order for the purposes of the
Mental Health (Compulsory Assessment and Treatment) Act 1992 , and, in making
the order, the court must specify whether, for the purposes of that Act, the
order takes effect as a community treatment order or as an inpatient order.

An order made under section 25(1)(b) is to be regarded as a
compulsory care order for the purposes of the
Intellectual Disability (Compulsory Care and Rehabilitation) Act 2003 , and,
in making the order, the court must— a) direct whether the defendant is to
be detained in a secure facility; and
b) specify the term of the order in
accordance with section 46 of that Act .
