DISTRICT COURT ACT 2016 - SECT 7
District Court
1 This Act establishes the District Court of New Zealand (the
"court" ).
2 The court consists of— a) the Chief District Court Judge; and
b) the Principal Family Court Judge and the Principal Youth Court Judge; and
c) the other District Court Judges.
3 The court has civil and criminal
jurisdiction and is a court of record.
4 The court is a single court that
replaces the District Courts that were continued by the
District Courts Act 1947 .
5 On and after the coming into force of this
Act,— a) a District Court in existence immediately before the coming into
force of this Act is part of the court:
b) any act or thing that was done in
relation to a proceeding commenced in a District Court before the coming into
force of this Act is to be treated as having been done in the court sitting in
the same place as that District Court:
c) any act or thing that could have
been done in relation to a proceeding commenced in a District Court before the
coming into force of this Act must be done in relation to the proceeding in
the court sitting in the same place as that District Court.
6 In subsection
(5),
"District Court" includes a Family Court or a Youth Court that was a division
of the particular District Court.
