Discretionary increases in payment amount by Order in Council
71O Discretionary increases in payment amount by Order in Council
1 The
Governor-General may, at any time, by Order in Council made on the
recommendation of the Minister, increase the rate of parental leave payment
that applies under section 71M(1)(a) and section 71M(1A)(a).
2 The
Minister, in making the recommendation, may base his or her decision on any
factors that he or she thinks fit.
3 An order under this section— a) is
secondary legislation (see Part 3 of the Legislation Act 2019 for publication
requirements); and
b) must be confirmed by an Act (see subpart 3 of Part 5
of the Legislation Act 2019 ).

2002, by section 4(2) of the
Parental Leave and Employment Protection (Paid Parental Leave) Amendment Act 2002
(2002 No 7). Section 71O(1): amended, on 1 July 2006, by
section 38 of the Parental Leave and Employment Protection (Paid
Parental Leave for Self-Employed Persons) Amendment Act 2006 (2006
No 20). Section 71O(3): inserted, on 28 October
2021, by section 3 of the Secondary Legislation Act 2021 (2021
No 7).
