SENTENCING ACT 2002 - SECT 80M
Appeals in respect of substituted sentences
80M Appeals in respect of substituted sentences
1 This section applies if a
court orders— a) cancellation of a sentence of home detention and
substitution of another sentence under section 80F ; or
b) cancellation of a
sentence of imprisonment and substitution of a sentence of home detention
under section 80K .
2 For the purposes of any appeal or application for leave
to appeal against the substituted sentence, a sentence substituted for a
sentence imposed on the conviction of the offender on a charge is deemed to be
a sentence imposed on the conviction of the offender on that charge.
History:
Section 80M: inserted, on 1 October 2007, by section 44 of the
Sentencing Amendment Act 2007 (2007 No 27). Section 80M(2):
replaced, on 1 July 2013, by section 7 of the Sentencing Amendment Act
(No 2) 2011 (2011 No 93).
