SECONDARY LEGISLATION ACT 2021 - SECT 3

3 Amendments to Acts as set out by administering agency in Schedules 1 to 32

1 Amend the Acts set out in the tables in Schedules 1 to 32 of this Act, in each case,—

a) at the location specified in the first column of the table; and

b) in the manner specified in the second column of the table.

2 Subsection (3) applies where an amendment in the second column of a table in Schedules 1 to 32 has the effect of inserting text that includes the placeholder [standard text].

3 For each placeholder, substitute secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).

ExampleA row of a table in Schedule 2 relating to the Corrections Act 2004 reads as follows: LocationAmendmentAfter section 2(2)Insert:3An order under this section is [standard text].This inserts the following subsection after section 2(2) of the Corrections Act 2004:3An order under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).

4 The codes stated in relation to an amendment are a guide only to the current and future status of the instruments to which amendments relate.

5 If—

a) an item in Schedules 1 to 32 amends a provision (
"provision A" ) of an Act (the
"amending Act" ) to make changes to text (
"inserted text" ) that is to be inserted into another Act (the
"principal Act" ); and

b) provision A comes into force before the date on which section 10 of the Legislation (Repeals and Amendments) Act 2019 comes into force,—

the item is taken to make those changes to the inserted text as inserted into the principal Act (and not to amend provision A).
