42 Costs of remote appearances from Australia
1 Unless the New Zealand court or tribunal otherwise orders, the costs
involved in the party, the party's counsel, or both participating in hearings
by using a remote appearance medium, under section 23(4) or, as the case
requires, under leave given under section 38 , must be paid by the defendant
who made under section 23(4)(c) a request to appear remotely or, as the
case requires, the applicant for that leave.
2 The New Zealand court or
tribunal may make an order specifying the amount payable by a party under
subsection (1), and requiring the party to pay that amount.
3 An order made
under subsection (2) by a tribunal that does not have the power to enforce its
orders— a) may be filed in the District Court; and
b) when so filed, is
enforceable as a judgment of the District Court.
