TRANS-TASMAN PROCEEDINGS ACT 2010 - SECT 63
Effect of registration and notification
63 Effect of registration and notification
1 A registered Australian judgment has the same force and effect, and may give
rise to the same proceedings for enforcement, as if it were a judgment given
by the New Zealand court in which it is registered.
2 However, if notice of
the registration of the judgment has not been given to every liable person
under section 62 , then subsection (1) applies to the judgment only after
45 working days of the New Zealand court after the day of registration.
3
Subsection (1) is subject to— a) section 64 (which prevents enforcement of
the judgment if it is not capable of being enforced in or by the original
court or tribunal or in or by another Australian court or tribunal); and
b)
any order under section 65(1)(a) or (b) (delaying or staying enforcement of
the registered judgment so that a liable person can challenge it in an
Australian court or tribunal), or any other order of a New Zealand court,
delaying or staying enforcement of the judgment; and
c) section 67 (which
relates to interest on a sum of money payable under a registered Australian
judgment).
