New Zealand Repealed ActsThis legislation has been repealed.
1 Within 15 working days after being notified under section 39(1) or 40(1) , a union that has members within the coverage of the proposed FPA must send a notice to each employer that is a party to a current collective agreement with the union, if the collective agreement covers employees who are within the coverage of the proposed FPA.
2 The notice to the employer must—a) advise the employer that the chief executive has approved initiating bargaining for the proposed FPA; andb) advise the employer where to find the notice issued by the chief executive under section 37 ; andc) include the statement provided under section 39(2)(c) ; andd) include the form provided under section 39(2)(d) .
3 If a union provides an employer with a statement under subsection (2)(c) and a form under subsection (2)(d), the union—a) must not amend the wording of the statement or the form before providing it to the employer; butb) may provide information to the employer that is additional to the information contained in the statement and the form.
