20 Powers of High Court on applications for interim relief

251 AN ISSUE has been raised by AMINZ as to whether the words “as it has for the purposes of proceedings before that court” in Article 9(2) of the First Schedule and the phrase “as it would have in civil proceedings before that court” at the end of clause 3(3) of the Second Schedule unduly restrict powers of the High Court or the District Court to grant interim relief.

252 We take the view that the powers of the court to give assistance to the arbitral tribunal and to order interim relief cannot go beyond the powers conferred upon those courts. We are not prepared to make any recommendations in relation to this issue.
